AODA Customer Service Standards – Are You In Compliance?

Although the requirements under the Accessibility Standard for Customer Service have been in effect since January 1, 2012, the Ontario government is planning on starting to conduct compliance audits in 2014.

For employers with less than 20 employees this means you must create a customer service policy for customers with disabilities.  You must also train all of your employees in regards to this policy.

In addition, employers with more than 20 employees must document the policy and training and report to Service Ontario on their compliance with the Accessibility Act.  The policy must be available for your customers to view.

For this purpose, the number of employees includes full time, part time, seasonal and contract employees.

The government has the power to conduct inspections, assign monetary penalties and prosecute organizations that persist in not meeting their obligations under this Act.

As of January 1, 2014 there are new requirements for organizations with 50 or more employees.  These new standards include the implementation and documentation of a multi-year accessibility plan to prevent and remove barriers under the Accessibility Standards Regulations.  Also, any updates to your website must conform to the World Wide Web Content Accessibility Guidelines 2.0 Level A (unless an exception applies).  A compliance report on this new area must be filed on or before December 31, 2014.

As of January 1, 2015 new construction and renovations will be subject to updated accessibility regulations.  This should be kept in mind when planning updates to your facilities.
